MCA Consumer Protection Plan Agreement
By purchasing the MCA Consumer Protection Plan, you (hereinafter Client) agree to all the terms and conditions for the services offered by Mortgage Consumer Advocates (hereinafter MCA). MCA is offering to Client its Consumer Protection Plan. This plan is a consulting agreement between the parties to assist the Client from unfair and unwarranted charges by the Mortgage Lender or Broker. MCA and its representatives will not receive any remuneration on the loan being made or recommend any specific lender or Broker for a loan. The terms of this agreement include the following:
- MCA will evaluate the following loan documents for the Client, which will include, but is not limited to, the Good Faith Estimate, the Lender or Broker Contract, and the Truth-in-Lending Statement and make recommendations to the Client on the fairness of these fees and charges.
- Client agrees to send these documents via secured fax line to 281-667-3288 or via secured email to DocReview@mortgagechampions.org within 3 business days of initial request and billing.
- MCA will have an MCA representative contact the Client by e-mail within 48 business hours of receipt of these initial documents with recommendations.
- Approximately 24 hours before the Client’s loan closing or as soon as the Client receives his/her closing statement (called a HUD I), Client agrees to sent this to MCA’s representative who has been assigned to the Client as instructed. This may be done by faxing the document to the representative’s personal fax number or by scanning the HUD I closing statement or by e-mailing it to the MCA representative. Allow at least 4 hours for MCA’s representative respond to you with a recommendation via e-mail or by phone.
- In cases where MCA finds that the Client’s documents have been altered unnecessarily in favor of the Lender or Broker, MCA will make a good faith effort to assist the Client in getting the Lender or Broker to honor their previous written commitments. An MCA representative also will assist the Client in filing a complaint against the Lender or Broker to the proper state or federal agencies if necessary. MCA will not give out any legal advice, but will be willing to speak with a Client’s attorney in case of unfair or unscrupulous dealings by a Lender or Broker with Client.
- If Client needs MCA or one of it representative’s to further advise their attorney beyond an initial phone call, or give expert advise for any legal action, this will be negotiated with a separate fee agreement with MCA.
- What this service does not include:
- It does not include phone calls on every phase of the process. We offer this information free on the MCA’s website or you may call your mortgage broker or lender.
- It does not include advice regarding the best loan program for the Client, even though MCA may ask the Client questions about the program being recommended by the Lender or Broker the Client should speak in more detail with a loan officer about other loan products available. General loan product information is free to the Client on the MCA website.
- MCA is not a lender or broker and will not directly give you to a lender or Broker; however a list of lenders who have agreed to meet MCA’s Code of Ethics is available on our site, and if a dispute arises with any of these listed lenders, MCA’s representatives will assist Client with the Lender or Broker.
MCA is not responsible for the loan the Client may choose to close. This decision is the sole responsibility of the Client. MCA does not have all the information a lender or broker might have to make a fully informed recommendation.
MCA is not responsible for the content of other websites linked to its pages and of any mortgage calculator which might be linked to MCA.
Client agrees that if he/she is dissatisfied with the service by MCA or the service did not fulfill the need of the Client, then the maximum obligation from MCA is the remuneration of the Client’s $99.00 given to MCA for the program, and Client agrees that no other obligation will be sought or owed.
Both parties agree that if any dispute arises, from the services rendered under this agreement, that any legal action will be settled in a court of competent jurisdiction in Harris County, Texas under the laws of the state of Texas.
By purchasing MCA’s service, Client agrees to all terms and conditions of this agreement from the date the service was rendered.
Privacy Notice: MCA will never release, distribute, sell, give out, or in any way release private information provided to us to anyone other than MCA representatives working on your file. We will take necessary steps in securing any physical or electronic data to protect your privacy.
